Terms of Service
The short version: Use WishEveryone to send genuine, well-intentioned birthday and anniversary wishes to real people you know. Don't use it to spam, harass, or do anything that would embarrass you if your contacts found out. We can suspend accounts that violate these terms.

1. Acceptance of Terms
By creating an account on WishEveryone ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
These Terms apply to all users of WishEveryone, including the web app at wisheveryone.com and any associated mobile applications.
2. What the Service Does
WishEveryone is an automated wish-sending platform. The Service allows you to:
- Store contact information (names, phone numbers, email addresses, birthdays, anniversaries)
- Automatically generate personalized messages using AI (Google Gemini)
- Deliver those messages by email and/or WhatsApp on the occasions you specify
- Send custom announcements to multiple contacts at once
- Receive push notifications and reminders about upcoming occasions
The Service is designed for personal and small-business use — to help individuals maintain genuine relationships by ensuring they never miss an important occasion.
3. Accounts and Registration
Eligibility
You must be at least 13 years old to use WishEveryone. By registering, you confirm that you meet this requirement.
Account responsibility
You are responsible for:
- Keeping your password secure and confidential
- All activity that occurs under your account
- Notifying us immediately at hello@wisheveryone.com if you suspect unauthorized access
We reserve the right to suspend or terminate accounts that are inactive for more than 12 consecutive months.
4. Acceptable Use
You agree to use WishEveryone only for lawful purposes and in a way that does not infringe the rights of others. Specifically, you must not:
- Use the Service to send spam, unsolicited commercial messages, or bulk messages to people who do not know you
- Add contacts without a genuine personal or professional relationship with them
- Use the Service to harass, threaten, or intimidate any person
- Send messages that are defamatory, offensive, discriminatory, or illegal
- Attempt to reverse-engineer, scrape, or exploit the Service's API or infrastructure
- Create multiple accounts to circumvent usage limits or suspensions
- Use automated scripts or bots to interact with the Service (beyond the Service's own automation features)
- Impersonate another person or entity in messages sent through the Service
Violation of these rules may result in immediate suspension or permanent termination of your account without refund.
5. Your Contacts' Data
When you add a contact to WishEveryone, you are providing us with personal information about a third party who has not directly agreed to these Terms. By doing so, you confirm that:
- You have a genuine personal or professional relationship with that person
- You are entitled to share their contact details for the purpose of sending them a wish
- You will honor any request from that person to stop receiving messages from WishEveryone on your behalf
- You will delete a contact's details promptly if they ask you to, or direct them to our data deletion page
You retain ownership of the contact data you add. We process it only to provide the Service to you. Full details are in our Privacy Policy.
6. WhatsApp Delivery
WhatsApp delivery is available on the Plus and Family plans. By enabling WhatsApp delivery, you agree to:
- Use WhatsApp delivery only to send genuine occasion wishes to real people you know personally or professionally
- Comply with WhatsApp's Business Policy and Meta's Advertising Policies
- Honor STOP requests — any recipient who replies STOP will be immediately opted out and will not receive further WhatsApp messages through WishEveryone
- Not use WhatsApp delivery to send promotional, commercial, or marketing messages beyond genuine personal wishes
We reserve the right to suspend WhatsApp delivery for accounts that generate excessive opt-outs, complaints, or violations of WhatsApp's policies. Abuse of WhatsApp delivery may result in your account being permanently banned from using that feature.
7. AI-Generated Content
Messages generated by WishEveryone are produced by Google Gemini AI. By using the Service, you understand and agree that:
- AI-generated messages may occasionally be imperfect, generic, or unsuitable for a specific context
- You are responsible for reviewing messages before they are sent if you have enabled "review before sending" mode
- WishEveryone is not liable for any harm arising from an AI-generated message that you chose to send (or allowed to send automatically) through the Service
- The content of messages sent belongs to you — we claim no ownership over AI-generated wish content
We use Google Gemini to generate messages. By using this feature, you also agree to Google's Terms of Service. We pass only the contact's first name, relationship type, occasion, and your chosen message style to Gemini — never phone numbers or email addresses.
8. Payment and Billing
Free plan
The Free plan is provided at no cost and includes unlimited contacts and email delivery. We reserve the right to introduce reasonable usage limits on the Free plan with 30 days' notice.
Paid plans
Plus ($3/month) and Family ($8/month) plans are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis.
- You may cancel at any time — your plan remains active until the end of the current billing period
- No refunds are issued for partial billing periods
- If a payment fails, we will attempt to retry for up to 7 days before downgrading your account to the Free plan
Price changes
We will give at least 30 days' notice of any price increase via email. Continued use of the paid plan after that date constitutes acceptance of the new price.
9. Termination
By you
You may delete your account at any time from within the app Settings. All your data will be permanently deleted within 30 days of account deletion.
By us
We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use policy. For serious violations (spam, harassment, WhatsApp abuse), we may terminate without prior notice. For less serious violations, we will typically give you a warning first.
If we terminate your account due to a violation, you are not entitled to a refund of any prepaid fees.
10. Disclaimers and Liability
Service availability
WishEveryone is provided "as is" and "as available." We do not guarantee uninterrupted, error-free service. Scheduled wishes may occasionally fail to deliver due to factors outside our control (email spam filters, WhatsApp delivery restrictions, third-party service outages).
Limitation of liability
To the maximum extent permitted by law, WishEveryone and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service — including, but not limited to, damages from a missed birthday wish, a failed delivery, or an AI-generated message that was not well-received.
Third-party services
WishEveryone relies on third-party services (Supabase, Resend, Twilio, Google Gemini, Render, Cloudflare). We are not responsible for outages, failures, or policy changes by these providers that affect the Service.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
The "last updated" date at the top of this page reflects the most recent revision.
